SUMMER GIFT CARD GIVEAWAY CONTEST (2013)
THIS CONTEST IS OPEN TO CANADIAN RESIDENTS ONLY AND IS GOVERNED BY CANADIAN LAW.
1. Contest Period and Eligibility:
The Home Hardware Spring Gift Card Giveaway Contest ("Contest") is open only to residents of Canada, who have reached the age of majority in the province/territory in which they reside, excluding employees, representatives or agents (current and retired) and all those with whom they are domiciled (whether related or not) of Home Hardware Stores Limited ("Sponsor"), its advertising and promotional agencies, the contest judging organization, prize suppliers, the dealers and employees of Home Hardware Stores, Home Hardware Building Centre Stores, Home Building Centres Stores and Home Furniture Stores including their respective affiliates, parents, subsidiaries, representatives, and agents ("Contest Parties").
Contest begins on July 1, 2013 at 12:00:01 a.m. Eastern Time (ET) and ends on August 5, 2013 at 11:59:59 p.m. ET ("Contest Period"). To be eligible, entries must be received no later than 11:59:59 p.m. ET on August 5, 2013, the Contest close date ("Contest Closing Date").
2. How To Enter: No purchase necessary. Starting on July 1, 2013, and during the Contest Period you may enter the Contest in one (1) of the following ways:
(1) Register for the Home Insiders Program online at www.homehardware.ca to receive marketing and promotional material from the Sponsor. To register, follow the onscreen instructions and click on the "Enter Now" button and an entry form will appear. Fully complete the entry form, which will require you to enter your first and last name, address (including postal code), telephone number (including area code), age and valid email address. Submit your completed entry form to receive one (1) entry into the Contest. You may unsubscribe from the Home Insiders Program at any time without affecting your eligibility in the Contest; Or
(2) Hand-write an original and unique minimum 50 word essay on 8 ½ x 11 paper on why you enjoy shopping at Home Hardware and print your first name, last name, address (including postal code), age, telephone number (including area code), and valid email address on the paper. Mail your essay in a postage paid envelope postdated on or before the Contest Closing Date to Home Hardware Spring Gift Card Giveaway Contest c/o Real Decoy, 205 Catherine Street, Unit 100, Ottawa, ON, K2P 1C3 to receive one (1) entry into the Contest.
(3) If you had registered for Home Insiders Program on www.homehardware.ca as of June 30, 2013, and are otherwise eligible to enter the Contest, you will be sent an email message, using the email address you provided at your time of registration, encouraging you to enter into the Contest. If you wish to enter the Contest, click on the "Enter Now" button and follow the on screen instructions as per 2(1) above to receive one (1) entry into the Contest. You may unsubscribe from the Home Insiders Program at any time without affecting your eligibility in the Contest.
REFER A FRIEND
If you share the contest with one or more eligible friends on specified social media sites you will receive one bonus entry ("Bonus Entry")
On the share page you have the option to click on the icon of your choice (Facebook, Twitter, LinkedIN or email) to share the offer/contest with your friends and family. When you click the icon, a pop-up window opens with the pre-populated message, inviting you to make an additional comment and Post to your wall or newsfeed (optional). When you are done sharing (or choose not to as sharing is not mandatory), click the "Back to Home" button which takes you to the homepage of Homehardware.ca.
Refer a friend: The referred email addresses will only be used by the Sponsor for the purpose of contacting your friend(s) or family, on your behalf, to provide information about the Contest so they can sign up if they choose to do so and they will not be added to any direct marketing list or used in any direct marketing programs without their consent. There is a maximum of five (5) friends or family you may invite during the Contest Period. An Entrant cannot invite the same friend or family member more than once. Each friend or family member will be sent an email containing a link to the Contest website. This email will indicate that it has been sent on your behalf and will identify you. You may only invite friends or family from whom you have received permission to provide their email address to the Sponsor, and by whom an email from you or Sponsor would not be considered spam or otherwise objectionable. For the purposes of this clause, you may only refer friends with whom you have a personal relationship.and that friend has not indicated that they do not wish to receive commercial electronic messages from you. You may only refer family members to whom you are related by blood relationship, marriage, a common-law partnership, or adoption. Entrants will receive a maximum of one (1) Bonus Entry when they invite one or more unique and eligible friends or family members during the Contest Period regardless of whether such friend or family member actually enters the Contest . Entrants who refer multiple friends or family members will receive a maximum of (1) one Bonus entry regardless of the number of friends or family members they refer.
Entries into the Contest through any of the methods outlined above are "Entries". All Entries are subject to verification at any time. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor - including, without limitation, government issued photo identification) to participate in this Contest. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification. The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Contest server machine(s).Entries into the Contest through any of the methods outlined above are "Entries". There is a limit of one (1) Entry and one (1) Bonus Entry per person/email address permitted during the Contest Period, regardless of method of Entry. For greater certainty, you can only use one (1) email address to enter the Contest. If it is discovered that you have attempted to: (i) obtain more than one (1) Entry or Bonus Entry per person/email address during the Contest Period; or (ii) use more than one (1) email address to enter the Contest; then (in the sole discretion of the Sponsor) you may be disqualified from the Contest and all of your Entries may be voided. Your Entry will automatically be rejected if (in the sole and absolute discretion of the Sponsor) the entry form is not fully completed and submitted during the Contest Period. Use (or attempted use) of multiple names, identities, email addresses and/or any automated, macro, script, robotic or other systems(s) or program(s) to enter or otherwise participate in or disrupt this Contest is prohibited and is grounds for disqualification by the Sponsor. The Releasees (defined below) are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries.
3. The Prizes and their Approximate Retail Values:
There is one Grand Prize available to be won. The Grand Prize consists of a Home Hardware Gift Card with a total value of $1000.00 (CDN) ("Grand Prize").
There are 36 Secondary Prizes available to be won, each consisting of one (1) Home Hardware Gift Card with a total value of $100 (CDN) (each a "Secondary Prize").
Collectively the Grand Prize and the Secondary Prizes are "Prizes". The Prize Gift Cards are valid at all Home Hardware Stores across Canada. The Gift Cards are subject to the following terms and conditions: (i) If lost, stolen or destroyed, card cannot be replaced without receipt (the letter from Home Hardware confirming the winner has won the Prize); (ii) Gift Cards cannot be redeemed for cash or applied to winner's Homecard or winner's Home Hardware in-house credit account; and (iii) Gift Cards do not expire and have no service fees ("Terms").
Prizes may not be exactly as shown in Contest publicity or promotional materials. All incidental costs and expenses not specifically referred to shall be the responsibility of winner. All incidental costs and expenses not specifically referred to shall be the responsibility of the winner. Prizes must be accepted as awarded and are not transferable or convertible to cash. No substitutions except at Sponsor's option. Sponsor reserves the right, in its sole and absolute discretion, to substitute the Prize or a component thereof with a prize of equal or greater value, including, without limitation, but at Sponsor's sole and absolute discretion, a cash award. Prize will only be awarded to the person whose full name and valid email address appears on the official Contest entry form.
Maximum one (1) Prize per person. For greater certainty, winners of Secondary Prizes will not be eligible for the Grand Prize draw.
4. Prize Draws and Odds of Winning:
Secondary Prize Draws: There will be a total of 36 Secondary Prize Draws, one in respect of each day during the Contest Period (each a "Secondary Prize Draw"). Each day starting on July 2, 2013, and continuing until August 6, 2013, (each a "Secondary Prize Draw Date"), in Ottawa, Ontario at 10:00:00 a.m. ET, one (1) eligible entrant will be selected by random draw from among all eligible previously unselected Entries received during the Contest Period and prior to 11:59:59 a.m. ET on the day before the applicable Secondary Prize Draw Date (each an "Entry Cut Off Time") and deemed a potential winner of a Secondary Prize. The odds of winning a Secondary Prize depend on the number of eligible Entries received during the Contest Period prior to the applicable Entry Cut Off Time.
For greater certainly, non-winning eligible Entries will carry forward to be eligible in subsequent Secondary Prize Draws and the Grand Prize draw.
Grand Prize Draw: On August 12, 2013 (the "Grand Prize Draw Date") in Ottawa, Ontario at 10:00:00 a.m. ET, one (1) eligible entrant will be selected by random draw from among all eligible Entries received during the Contest Period to be the eligible winner of the Grand Prize. The odds of winning the Grand Prize depend on the number of eligible Entries received during the Contest Period.
Collectively, the Secondary Prize Draw Dates and the Grand Prize Draw Date are "Draw Dates".
5. Contacting Eligible Winners: Contest organizers will attempt to contact the eligible winners by telephone, mail or e-mail, using the information provided at their time of entry, within 10 business days following the applicable Draw Date. In order to be declared a confirmed winner, each selected entrant must first have complied with the rules and correctly answered, unaided, a time limited mathematical skill-testing question to be administered by ballot format, e-mail or telephone by the contest judging organization at a prearranged mutually convenient time or on the release form signed by the selected entrant. If a selected entrant (i) cannot be contacted after 3 attempts or 10 business days of the applicable Draw Date (whichever occurs first); or (ii) if there is a return of any notification as undeliverable; or (iii) if contacted entrant does not claim his or her Prize on or before date and time specified by the Sponsor, or does not meet all of the contest conditions, then selected entrant will be disqualified and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such new selected entrant) and the Contest organizers and Sponsor shall be fully and completely released and discharged from any liability or responsibility of any nature and kind to any previously selected entrant in this regard.
BEFORE BEING DECLARED A WINNER OF ANY PRIZE: Before being declared a winner, each selected entrant will be required to sign and return to the Sponsor, the Sponsor's standard declaration and release form within the time specified by the Sponsor, which (among other things): (i) confirms compliance with these Rules and agreement to be bound by them; (ii) acknowledges acceptance of the Prize as awarded; (iii) releases the Contest Parties and each of their respective affiliates, parents, dealers and related entities, as well as directors, officers, dealers, partners, partnerships principals, agents, representatives, volunteers, sponsors, promoters, advertisers, employees, successors and assigns (collectively, the "Releasees") from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet. If the selected entrant: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest documents within the specified time; and/or (c) cannot accept the Prize for any reason; then he/she will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such new selected entrant).
The decisions of the Contest Sponsors and contest judging organization are final. Each confirmed winner will be instructed how to claim their Prize.
6. General Conditions: This Contest is subject to all applicable Federal, Provincial and Municipal laws. Void where prohibited. All Entries become the property of the Sponsor and will not be returned.
In the event of a dispute regarding who submitted an Entry, Entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. "Authorized account holder" is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. An entrant may be required to provide proof (in a form acceptable to the Sponsor - including, without limitation, government issued photo identification) that he/she is the authorized account holder of the email address associated with the selected Entry.
Publicity: By entering the Contest, each entrant agrees to be bound by these rules and the decisions of the Sponsor and the Contest judging organization, and the each winner consents to (a) filming and/or photographing of the winner; and (b) the use of each winner's name, city of residence, likeness, photograph, image, voice, comments, as captured in filming, photograph or other medium for use in perpetuity by the Sponsor throughout Canada without payment or compensation, in any publicity or advertising in any medium carried out by the Sponsor and each winner must agree to sign the appropriate release documentation to give effect to this consent.
Termination: Sponsor reserves the right, subject, subject only to the approval of the Régie des alcools, des courses et des jeux (the "Régie") in Quebec, to cancel, modify, terminate or suspend this Contest in whole or in part if for any reason the Contest is not capable of running as planned, including but not limited to, technical failure, or computer virus, tampering, fraud, or corruption of security or proper administration of the Contest without prior notice. In such event, winners may be selected by randomly drawing from among all valid Entries received up to such time of cancellation, termination or suspension. The Sponsor, with the consent of the Régie, reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason.
The Sponsor reserves the right, in its sole and absolute discretion, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of technical problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules.
Hold Harmless: By entering this Contest, entrants release and hold harmless the Releasees from any liability in connection with this Contest or participation in any Contest related activities or, if declared a winner, the use or misuse of a Prize. In particular, the Sponsor will not be responsible if for any reason a Prize winner is not satisfied with his/her Prize. This Contest will be run in accordance with these Rules, subject to amendment by the Sponsor.
Liability: Under no circumstances, including without limitation, negligence, shall the Releasees be liable for: any injuries, loss or damages of any kind (compensatory, direct, incidental, consequential or otherwise) with respect to, or in any way arising from, this Contest, the Prizes awarded, or participants' or any other persons' computer system(s); lost, destroyed, damaged, misdirected, illegible, incomplete or late entries, which will be void; or incorrect or inaccurate capture of entry information, technical failure or error, seeding or printing errors, lost/delayed/garbled data, transmissions, omissions, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, servers, software, traffic congestion on the internet or any website or any other online communication problems or any combination thereof. Entry materials that have been tampered with, reproduced, falsified or altered are void. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. This exclusion or limitation of liability will not apply to the extent that any applicable statute prohibits such exclusion or limitation of liability.
Language Discrepancy: In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the Contest entry form, French version of these Rules, and/or point of sale, television, print or online advertising; the terms and conditions of these English Rules shall prevail, govern and control.
Undermine Promotion: Any attempt by an entrant or other individual, to deliberately damage any website or undermine the legitimate operation of this promotion, including but not limited to any fraudulent claims, is a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution. Entrants engaging in any of the foregoing activities may be disqualified and will forfeit any Prizes won.
Errors: The Sponsor shall not be responsible for typographical or other errors in the offer or administration of this Contest, including but not limited to, errors in advertising, the official rules, the announcement of winner, distribution of a Prize or any technical malfunctions.
Governing Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these official Contest rules, or the rights and obligations of entrant and the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the Province of Ontario and the federal laws applicable therein without regard to Ontario conflicts of law principles. All entrants consent to the jurisdiction and venue of the Province of Ontario.
For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
