SMS Alerts Terms and Conditions

Your use of SMS Alerts is subject to the Home Hardware’s Privacy Policy and Terms and Conditions. If there is any conflict or inconsistency between these Terms and Conditions and the Terms of Use, solely with respect to the SMS, these Terms and Conditions shall govern and prevail.

Sign up for Home Hardware’s consumer email service by texting EMAIL to 14475 or for the contractor email services by texting PRO to 14475. The SMS alert service provides a one-time SMS conversation requesting basic contact information needed to opt into Home Hardware’s promotional email service. A total of 4 messages will be sent to complete the email service registration. The SMS alerts are a one-time only service and does not enroll you for future SMS promotional alerts. 

Sign up for Home Hardware’s Promotional SMS Alerts via online submission form on homehardware.ca. Upon submission of your mobile number to Home Hardware’s Promotional SMS Alert program, you will receive SMS text messages confirming your opt-in to receive MMS and SMS text messages to your mobile number. By signing up, you will receive approximately one or two messages per week, though messaging frequency may vary. 

While there is no cost imposed by Home Hardware for you to utilize the SMS, standard data fees and text messaging rates may apply based on your plan with your mobile phone carrier. If you have any questions about your text plan or data plan, it is best to contact your wireless provider. To stop receiving Home Hardware’s Promotional SMS Alerts, simply text STOP to the short code 14475, or email [email protected]. After doing so, you will receive a text message confirmation of your opt-out, and thereafter, you will no longer receive Home Hardware’s MMS or SMS text messages to the mobile number from which you opted-out.

What are the Participating Carriers? 

Home Hardware is able to deliver messages to the following major mobile phone carriers: 

Aliant Mobility, Bell Mobility, Eastlink, Fido, Mobilicity, MTS, NorthernTel Mobility, Rogers Wireless, SaskTel Mobility, Telebec Mobilite, TELUS Mobility, Videotron, Virgin Mobile Canada, Freedom Mobile. Please note, however, that the supporting mobile carriers may change without notice, and the particular Text Message Service you join may be limited to specific carriers. The Service is not compatible with all cell phone models. Home Hardware is not responsible for any delays upon sending or receiving MMS or SMS text messages.

Commands 

STOP: Text STOP at anytime to the short code 14475 to opt-out. You will receive a text message confirmation of your opt-out, and thereafter, you will no longer receive any Home Hardware MMS or SMS text messages to the mobile number from which you opted out, unless you opt-back in. 

HELP: Text HELP at anytime to the short code 14475.Texting HELP will return the following message:

Your Contact Information 

You represent that you are the holder of the mobile phone number account you provide to Home Hardware Stores Limited or that you have the account holder’s permission to enter the mobile number in the Service and that you will not initiate messages to the mobile phone of any other person or entity. You agree to maintain accurate, complete, and up-to-date information with us, including by advising us immediately if you cease being the subscriber or regular user of your mobile number. 

The parties further agree that any arbitration shall be conducted in their individual capacities only and not as a class action or other representative action, and the parties expressly waive their right to file a class action or seek relief on a class basis. If any court or arbitrator determines that the class action waiver set forth in this paragraph is void or unenforceable for any reason or that an arbitration can proceed on a class basis, then the arbitration provision set forth above shall be deemed null and void in its entirety and the parties shall be deemed to have not agreed to arbitrate disputes. 

Notwithstanding the parties’ decision to resolve all disputes through arbitration, either party may also seek relief in a small claims court for disputes or claims within the scope of that court’s jurisdiction. 

The parties agree that any litigation between them shall be filed exclusively in the Province of Ontario, Canada.
